Silica Terms of Use

1. Application of These Terms

These Terms of Use (“Terms”) govern the use of the Silica iOS application (“Silica” or the “App”) provided by Taketo Fujimaki (“Provider,” “we,” “us,” or “our”). By downloading, installing, purchasing, or using Silica, the user agrees to these Terms.

Silica is intended for worldwide distribution. Mandatory laws in the user’s country or region take priority where they cannot lawfully be excluded by these Terms.

The Silica Privacy Policy applies to the processing of personal information and can also be viewed in the App’s Settings screen.

Apple’s Standard Licensed Application End User License Agreement and the applicable App Store terms also apply. If these Terms conflict with an applicable mandatory law or Apple term, that law or the term that more specifically governs the matter will control to the extent required.

2. License

Subject to these Terms, Apple’s terms, and the App Store Usage Rules, the Provider grants the user a limited, personal, non-exclusive, non-transferable, and non-sublicensable license to use Silica on Apple-branded devices the user owns or controls. Silica is licensed, not sold.

3. Features

Silica may provide:

  1. Automatic recording of stays and movement points
  2. Daily timeline and map views
  3. Saved places with editable names, matching radius, priority, and icons
  4. Estimated travel modes
  5. Markdown exports to a folder selected by the user
  6. Exports to a Notion page or data source selected by the user
  7. Automatic export of the previous day’s location log
  8. Optional Face ID lock

Silica is not an emergency service, medical service, safety service, employee-monitoring service, or cloud backup service. Silica does not provide a Silica user account or continuously store the user’s location history in a cloud database operated by us.

4. Permissions and Environment

Background visit recording may require “Always” location permission. Travel-mode estimates may require Motion & Fitness permission. Saving a Pro card image may require permission to add an image to Photos.

The user is responsible for managing device settings, network access, battery level, Apple Account access, export-folder permissions, Notion permissions, and connected-service settings. Some features may not function if a required permission, operating-system service, network service, or third-party service is unavailable.

5. Nature of Location Data

Coordinates, stays, times, addresses, place names, and travel modes are estimates produced from device sensors, Apple services, networks, map data, and reverse geocoding. Records may be missing, delayed, duplicated, or incorrect.

The user must not rely on Silica as the sole source for emergency location, medical or safety decisions, legal evidence, attendance records, fleet operations, or any other use requiring guaranteed accuracy.

6. User Data and Exports

The user retains rights in location history, saved-place names, settings, and other content created by the user. We do not sell that data and do not access or use it except as needed to provide selected features, protect the service, respond to the user, or comply with law.

When the user selects a folder, Silica may write Markdown files containing precise location history to that folder. The user is responsible for the folder’s access permissions and for any synchronization or sharing through iCloud, Obsidian, another file provider, or another application.

When the user connects Notion, Silica may send precise location logs through our API to the Notion destination selected by the user. The user is responsible for the selected workspace, page or data source, access permissions, sharing settings, and exported pages.

Deleting data inside Silica does not delete Markdown files already exported outside the App. Deleting App data or disconnecting Notion does not delete pages already exported to Notion. The user must delete those files or pages from the relevant destination.

7. Paid Features and Subscriptions

7.1 App Store purchases

Paid features are offered through Apple’s in-app purchase system. Apple handles payment, billing, receipts, taxes, and refund processing. Silica may use RevenueCat to verify purchases and provide entitlements.

7.2 Plans and prices

Silica may offer monthly, annual, and lifetime purchase options. The price, currency, tax treatment, duration, renewal conditions, and included features displayed in Silica and the App Store at the time of purchase apply to that transaction. The user should review the current purchase screen before confirming.

Pro features may include extended history access, automatic export, and increased saved-place limits. Features may change through updates, subject to applicable law and the terms presented at purchase.

7.3 Auto-renewable subscriptions

Monthly and annual subscriptions automatically renew for the displayed period unless canceled before the renewal date. Apple charges the user’s Apple Account under the App Store terms. The user can cancel or manage a subscription in Apple Account subscription settings. Deleting Silica does not cancel a subscription.

After cancellation, Pro access may continue until the end of the paid period, subject to Apple’s records and applicable law.

7.4 Lifetime purchase

A lifetime purchase does not auto-renew. It grants access to the Pro features made available in Silica under the terms shown at purchase. It does not transfer ownership of Silica or its intellectual property, and it does not include ownership of or guaranteed access to a separate future application or service. Except where required by law, it does not guarantee that Silica or every feature will operate indefinitely after the App is discontinued.

7.5 Purchase restoration

Silica provides a mechanism to restore eligible purchases made with the same Apple Account. Restoration may depend on Apple, RevenueCat, the account used for the original purchase, and App Store product configuration.

7.6 Refunds

Refund eligibility and requests are generally handled by Apple under App Store procedures and applicable law. We do not receive full payment-method details and cannot guarantee that Apple will approve a refund. Nothing in these Terms limits a non-waivable consumer right.

8. Prohibited Conduct

The user must not:

  1. Violate law or public policy
  2. Interfere with or abuse Silica, Apple services, Cloudflare, Notion, RevenueCat, or another third-party service
  3. Exploit a defect to obtain unauthorized access to another person’s data or paid features
  4. Reverse engineer, decompile, disassemble, modify, or attempt to derive source code except to the extent expressly permitted by applicable law or an open-source license
  5. Infringe intellectual-property, privacy, publicity, or other rights
  6. Access another person’s device, location information, account, workspace, or files without authorization
  7. Use Silica to secretly monitor or track another person or to collect another person’s location without valid consent
  8. Submit unlawful, abusive, deceptive, or malicious content through the support form

9. Intellectual Property

Silica, its name, logo, interface, software, text, and other materials are owned by the Provider or their respective licensors. These Terms do not transfer intellectual-property rights to the user.

Apple, Cloudflare, RevenueCat, Obsidian, Notion, map data, and third-party libraries remain the property of their respective owners and are subject to their terms and licenses.

10. Changes, Suspension, and Discontinuation

We may change, add, suspend, or discontinue features or availability for maintenance, security, legal compliance, operating-system changes, third-party-service changes, or product improvements.

Changes affecting a paid subscription will be handled under applicable law, Apple’s terms, and the terms presented to the purchaser. We will provide notice when required.

11. Disclaimers and Limitation of Liability

To the maximum extent permitted by law, Silica is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted operation, compatibility with every device or OS version, accuracy or completeness of location records, availability of a third-party service, or prevention of all data loss.

The user is responsible for maintaining appropriate backups of important data and exported files.

Liability is governed by applicable law. Any exclusion or limitation in these Terms does not apply to the Provider’s willful misconduct or gross negligence, or where liability cannot lawfully be excluded or limited, including under applicable consumer-protection law.

12. Termination

The user may stop using Silica at any time. Uninstalling the App does not automatically cancel an App Store subscription or delete files and Notion pages exported outside the App.

We may restrict access to API-dependent features if the user materially violates these Terms, attacks or abuses the API, or if restriction is reasonably necessary for security or legal compliance.

Provisions that by their nature should survive termination, including intellectual property, disclaimers, liability, governing law, and obligations concerning exported data, remain effective.

13. Changes to These Terms

We may update these Terms to reflect changes in law, Silica, pricing, or third-party services. If a change is material, we will provide notice through the App, the public website, or another appropriate method. Updated Terms apply from the stated effective date, subject to applicable law.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of Japan, without excluding any mandatory protection available under the law of the user’s habitual residence.

Any dispute concerning Silica or these Terms will be submitted to the court having jurisdiction under applicable law. If an exclusive forum agreement is legally permitted and valid for the dispute, the Tokyo District Court or Tokyo Summary Court will be the agreed court of first instance.
